These Terms and Conditions ("Agreement") govern your use of Expat Guard insurance services and form a legal contract between you ("Member") and Expat Guard ("Company"). Please read these terms carefully before purchasing coverage.
Acceptance of Terms
- •By purchasing Expat Guard insurance, you agree to these terms and conditions
- •These terms constitute a legal agreement between you and Expat Guard
- •If you do not agree to these terms, please do not use our services
- •We reserve the right to update these terms with 30 days written notice
- •Continued use after changes constitutes acceptance of new terms
Eligibility Requirements
- •Must be a US or Canadian citizen or permanent resident
- •Must currently reside in Latin America for 30+ days
- •Must maintain primary health coverage in home country (US/Canada)
- •Ages 18-85 are eligible for coverage
- •Must disclose all pre-existing medical conditions truthfully
- •Cannot be traveling for medical treatment purposes
Coverage Activation & Duration
- •Coverage begins 48 hours after first premium payment
- •Continuous coverage requires timely premium payments
- •Coverage lapses automatically if premiums are 15+ days overdue
- •Reinstatement requires full underwriting review
- •Coverage ends when you no longer meet eligibility requirements
- •You may cancel at any time with 30 days written notice
Premium Payments
- •Premiums are due monthly or annually as selected
- •Late fees apply to overdue payments (5% of premium)
- •Automatic payment failures will be retried for 3 business days
- •Coverage suspension occurs if payment fails after retry period
- •Annual payments receive 10% discount over monthly payments
- •Premium changes require 60 days advance notice
Claims Process & Requirements
- •All emergency situations must be reported within 48 hours
- •Pre-authorization required for non-emergency treatments
- •Claims must be submitted with complete documentation within 90 days
- •Fraudulent claims will result in immediate policy cancellation
- •We reserve the right to investigate all claims thoroughly
- •Payment will be made within 30 days of approved claims
Policy Limitations & Exclusions
- •Coverage is limited to medical emergencies and evacuations
- •Routine care, check-ups, and preventive services are excluded
- •Pre-existing conditions have specific coverage limitations
- •Treatment in home country only covered after evacuation
- •Maximum annual benefit limits apply as stated in your policy
- •Refer to policy documents for complete exclusions list
Dispute Resolution
- •Good faith effort to resolve disputes directly with customer service
- •Formal disputes subject to binding arbitration in Mexico City
- •Arbitration conducted in English under international commercial rules
- •Legal costs borne by each party separately unless agreed otherwise
- •Class action lawsuits are specifically waived by both parties
- •Emergency medical decisions not subject to dispute process
Limitation of Liability
- •Our liability limited to policy benefit amounts and premiums paid
- •Not liable for third-party medical provider actions or decisions
- •Force majeure events (war, natural disasters) may suspend coverage
- •No liability for indirect, punitive, or consequential damages
- •Medical treatment decisions remain between you and your physician
- •Coverage territory restrictions apply as outlined in policy
